Filing a Takedown Notice

If you believe that content on Gloom & Bloom infringes your copyright, you may submit a written takedown notice pursuant to 17 U.S.C. § 512(c). Your notice must include the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved).
  3. Identification of the material that is claimed to be infringing, including the URL or other specific location on our site where it appears.
  4. Your contact information — including name, address, telephone number, and email address.
  5. A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Counter-Notification

If you believe your content was removed in error or that you have authorization to use the material, you may file a counter-notification. Your counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it previously appeared.
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal court in your district (or Delaware if outside the US) and will accept service of process from the complainant.

Upon receiving a valid counter-notification, we will forward it to the original complainant and restore the material within 10–14 business days unless the complainant initiates a court action.

Repeat Infringer Policy

Gloom & Bloom maintains a policy of terminating access for repeat infringers in appropriate circumstances. If content is the subject of repeated valid DMCA complaints, we will take reasonable steps to permanently remove the infringing material and may disable access to the source.

Good Faith Statement

Please be aware that filing a false DMCA takedown notice may result in liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f). Before filing a notice, please consider whether the use of the material in question may constitute fair use.
